Hey fellow van luverz,

Just a quick survey-esque question:

Would anyone here confuse "NYC VIBE" with "VIBE MAGAZINE"? I'm in the process of attempting to register the "NYC VIBE" trademark but Vibe Media Group is of the opinion that since I'm a DJ and would be using the "NYC VIBE" mark (which shares the abbreviated form of the word VIBRATION: "VIBE" with their mark) to promote and/or perform as a collective of DJs, Musicians, etc that would cause confusion in the public's eye.

I'm trying to prove to them that just because we may share the word "VIBE" in the mark doesn't necessarily mean most people will confuse the two marks. The example I use prominently is Pontiac Vibe (the car).

Others that may share one word but don't necessarily cause confusion are Home DEPOT and Office DEPOT , Commerce BANK and BANK of America, GENERAL Electric and GENERAL Motors, etc, etc.

Would very much appreciate your unbiased thoughts.

Confusion? Are they also worried that people confuse you with the credit card? (Yes, I'm an heir to the Visa Card Empire!) Assuming you are EV of course.

At first appearence, no I would never relate "Vibe Magazine" with or to "NYC Vibe", especially with the word in question being at opposite ends of each mark. You may want to go an extra step and say for most of us out here in Demographicville, it would more be like comparing Depot Home to Office Depot.

As I read the two, the fisrt mark has the emphasis on "Vibe" (Magazine) with the second mark having the emphasis more on "New York City" (Vibe).


Did you ever come across the Patio Kings before they split? They have ties to Philly and Bellingham, Washingon and have worked thier way up to the number one spot on my Ipod. Luv their groove, incredible energy at live performances.

No confusion whatsoever. Vibe is a generic term. \:D/ It can be used in any number of ways. O:)
